CITY FILES ITS RESPONSE TO LAWSUIT
The City of Los Angeles fiels its response to the lawsuit filed by Concerned Dog Owners of California on June 5th. The final CDOC response is due June 22nd.
The main thrust ofthe City argument seems to be that whether this violates constitutional rights or not, the City is within its right to use its police powers to do whatever it wants. The fact that there was no rational basis for the law seems not to be refuted by the City.
Interestly, it is almost as if they are pre-supposing that the City will approve the new recommendations of the Commission on Spay and Neuter and revoke any rights to own an unaltered dog in the City of Los Angeles. That report and more information on the lawsuit can be seen here.
HISTORY OF ORDINANCE
The City of Los Angeles has passed an Ordinance scheduled to go into effect on 4/8/2008. This ordinance demands the Mandatory Spay and Neuter of all puppies and kittens by the time they are 16 weeks of age.
There are some exemptions for the people with the resources to show dogs or who own purebred dogs.
There are options for the affluent.
There is nothing for the typical dog owner who does not have the ability to spend more than $200 each year to license his dog.
The City Council was provided with health studies that detailed quite clearly the damage to dogs long-term physical and mental health with early spay and neuter. The City was not able to counter with any studies of their own.
CDOC Action was formed to fund and fight this issue in the courts. And we are asking for your generous contribution toward the costs of the litigation.
